Kazakhstan Justice Ministry delegation visits Dubai International Arbitration Centre to learn and exchange arbitration expertise

Dubai - The Dubai International Arbitration Centre (DIAC), an initiative of Dubai Chamber of Commerce and Industry, shared its experience and expertise in settling commercial disputes during a meeting between Dr. Habib Al Mulla, Chairman, Board of Trustees, DIAC, and the visiting high-level delegation headed by H.E. Baimoldina Zauresh Khamitovna, Deputy Minister of Justice, Republic of Kazakhstan.

The Kazakh delegation visit came in the framework of exchanging of experiences and know-how with the Dubai International Arbitration Centre, which is one of the world's leading centres for commercial arbitration and has, since its inception, been promoting the importance of arbitration in stimulating the business environment of Dubai and the region.

During the familiarisation visit, the Kazakhstan delegation expressed their desire to adopt and apply Dubai's world-class arbitration model in their country which is looking forward to raising the competency of the few independent tribunals operating there.

The official Kazakhstan delegation consisting of officials of Department of Legislation of the Ministry of Justice and the Embassy of Kazakhstan in the UAE, was received by Dr. Habib Al Mulla, Chairman, Board of Trustees, Dubai International Arbitration Centre.

Welcoming the delegation, Dr. Al Mulla thanked them for their interest in the outstanding activities of DIAC which he said is marking its 10th anniversary in November this year and has entertained 2,500 cases since its inception a decade ago.

He apprised the visitors with the leading role played by the Centre in providing efficient and impartial administration of commercial disputes to local and international business communities through a pool of experienced arbitrators drawn from different nationalities and legal backgrounds along with the various world-class commercial arbitration services.

The Chairman of DIAC supported the informative presentations provided by his case managers and answered the various questions raised by the Deputy Minister of Justice of Kazakhstan regarding the application of arbitration cases by the Centre, their enforcement and liability of the disputing parties.

Dr. Al Mulla enlisted three main rules for arbitration to be successful in any country of the world which he said included being part of the New York Convention on Arbitration, practising of world-class arbitration law or UNCITRAL Arbitration Rules as well as following of rules which are based on international standards set by International Chamber of Commerce or International Council for Commercial Arbitration. As for DIAC, the Centre has come up with rules that suit its functioning and are respected and accepted by other courts, he said.

On her part, H.E. Khamitovna lauded Dubai's role as a centre of alternative dispute resolution and the emirate's approach in adopting global best practices and merging them with the local laws.

She said that the delegation visit provided a learning experience which can be used in filling the gaps in the arbitration laws of Kazakhstan as the country is seriously working at introducing an independent, non-profit Arbitration Chamber which can be a central authority for the application and implementation of arbitration laws with some support from the Government.

The current Dubai International Arbitration Center (DIAC) is an autonomous, permanent, non-profit institution that provides the regional and international business communities a high caliber of arbitration services and facilities at an affordable price. Through DIAC's associate membership, members could enhance their knowledge and experience international commercial arbitration by participating in seminars, training workshops and international conferences. The services offered include the overseeing of arbitral proceedings and commercial disputes, appointing arbitrators, choosing the venue for the arbitration and fixing the fees of arbitrators and mediators.
