Mini-giant 'Trademark Registration Pocket Book Middle East 2010' supports SMEs and large businesses in legally upholding their IP rights

Millions of dirhams invested by companies in branding and marketing activities can come to naught if a simple thing like trademark protection is not considered carefully. To help companies understand the importance and procedures related to protecting trademarks, a pocket-book detailing these matters has been unveiled by Jitendra Consulting Group.

"The digital revolution has made the aspect of intellectual property complex and difficult to manage. Changing from country to country, the intricate laws of intellectual property can be difficult to comprehend," said Jitendra Gianchandani, Chairman and Managing Partner, Jitendra Consulting Group.

A slim volume of 64 pages measuring 15cm in length and 10cm in width, the 'Trademark Registration Pocket Book Middle East 2010' has been conceived, designed and published by Jitendra Intellectual Property, a member of JCA International and a division of Jitendra Consulting Group, to make trademark procedures and concepts easy to understand.

"The 'Trademark Registration Pocket Book Middle East 2010' is an endeavor that intends to support the efforts of SMEs as well as large corporations in upholding and protect their intellectual property rights," said Mr. Gianchandani, who has co-authored the pocket book along with Akhila Sreekumaran, Legal Consultant, Intellectual Property Services.

Understanding the process of owning a trade mark also helps businesses protect themselves against infringement of their mark.

"Often the owner of a mark notices that the product or label is being copied or infringed. But legal action is possible only if the whole procedure of registering and owning the mark is completed and a final certificate of ownership is received. Until then, the owner can't do anything against a competitor who is copying the product or mark," said Mr. Gianchandani.

"The pocket book has been developed as a guide for the potential users of trademark registration in Middle East countries. It clearly states the uses along with the benefits that shall ensue for investors, exporters, importers, manufacturers, SMEs and all those seeking to register their trademarks in Middle East countries," added Ms Sreekumaran.

With the UAE Ministry of Economy intensifying efforts to eliminate the use of counterfeit goods and products, the pocket book becomes more significant as a means of supporting this campaign. By registering its trademark, a business ensures the protection of its rights in the UAE. Registering trademarks also becomes necessary to help customers and authorities distinguish original goods from counterfeits sold in the market.

'Trademark Registration Pocket Book Middle East 2010' is aimed at providing the basic information regarding trademark registration procedures in Middle East countries and also at providing additional information about the 9th edition of the International Classification of Goods and Services (Nice Agreement).

"The pocket book is written primarily for those who have little or no knowledge of trademark registration, but have a reasonable understanding of the basic trademark concepts and terminology," Gianchandani said.

"For instance, many businesspersons assume that if they register the trademark in one country, it is protected in other countries. This is wrong. Each country has separate procedures and costs. Also, only international brands or well-known brands outside their home countries are protected under Article 4 of Trademark Law 37 of 1992 (amended by Law No. 8 of 2002); hence registering the trademark in each country is required or advisable," he said.

'Trademark Registration Pocket Book Middle East 2010' deals with all aspects of regional protection of a company's marks, such as:
The law on classification of goods and services
Jurisdictions and registration requirements in the GCC and other Middle East nations
Formats and procedures of registering a trademark, and
Worldwide trademark registration requirements
