Supreme Court of New South Wales Proceedings by Falak Holding LLC against Boulder Steel Limited, Dr Peter Wallner and Carl Moser
We refer to the announcement made by Boulder Steel Limited (Company) yesterday, 23 October 2008, regarding proceedings commenced by Falak Holding LLC (Plaintiff) in relation to a payment to Dr Peter Wallner.The court today made the following orders:
(a) that the Company give each of the current directors of the Company 48 hours notice of its intention to make any payment to a director or former director of the Company, Mr Carl Moser or Mr Daniel Owen other than payments of base salary, benefits or superannuation contributions, and of its intention to make any position in the Company redundant;
(b) that Dr Wallner by himself, his servants and agents be restrained from disposing of or otherwise dealing with any payment from the Company, or monies paid to him from the trust account of Wong & Mayes, chartered accountants, on or about 22 October 2008 except for $40,000.00 representing an amount equivalent for 2 months of Dr Wallner's total remuneration package;
