- Text size
For unit owners of Goldcrest Views 1 in Jumeirah Lakes Towers, it is not a handover issue.
They have been residing in the 40-storey residential tower for more than two years now, but have not received their title deeds yet.
JS, owner of a two-bedroom apartment in Goldcrest Views 1, told Emirates 24|7: "I only got the ownership agreement papers from the developer at the time of purchase and I have been told that I will get the title deed registration papers once the developer finishes the building registration formalities with Real Estate Regulatory AgencyReal Estate Regulatory Agency
[Rera].
It's now more than two years since I invested in the property and nothing has been done on this front."
JS bought his apartment from the secondary market in May 2006 by signing a sales and purchase agreement given by Mazyood Giga InternationalMazyood Giga International
, the developer of the tower.Although owners have approached the developer several times to get their title deeds, they have been informed that the process is under way.
"We have approached the developer several times and have been told that it's under process as ReraRera
and the Land DepartmentLand Department
have asked for fresh documents from Dubai Multi Commodities Centre [DMCC] and the developer. The developer told us that they have furnished all the requisite documents. However, every time I hear a new excuse in this regard," said JS.
This website reported earlier that the Dubai Cassation Court had introduced a new legal ruling necessitating the registration of the property purchase contract with the Land DepartmentLand Department
as means of proving property ownership.
The ruling stated that signing a contract is not enough to prove ownership of a property. The contract must be registered with the relevant department to be considered a valid document before the court.
officials on this issue, but said representatives of the owner's association have met department officials who have told them that the developer's papers are not in place to finish the registration process. The Interim Owners' Association, in a recent letter to the owners, informed that "no current owner of Goldcrest Views can advertise to sell his/her apartment unless it is first registered with the Land DepartmentLand Department
".
Mazyood Giga, DMCC and the Land DepartmentLand Department
did not respond to questions e-mailed by this website.
