Cabinet gears up to face Assembly grilling motions

KUWAIT: The Cabinet is considering methods by which it can curb the flood of grilling motions that have been filed, after it reaches an agreement on the legislative authority's abuse of its constitutional right .
It reiterated its commitment to push through with its development project plan. They confessed that the country is currently facing a critical situation while all set to host the GCC summit to be held next month.
On that regard, several high ranking officials have been pressuring the Cabinet to utilize the Article number 106, which stipulates that HH the Amir has the right to defer the National Assembly's meetings by one month, reported Al-Rai.
They indicated that such actions could be followed by taking similar steps like dissolving the Parliament or referring interpellation motions to the Constitutional Court.
The Cabinet is not entitled to refer a grilling motion to the Constitutional Court said Dr. Mohammad Al-Feely, a constitutional law professor at the Kuwait University(KU), and Dr. Obaid Al-Wasmy, Professor of Court Pleadings at the KU.
Dr. Al-Feely said that the Constitutional Court only interprets regulations, laws and constitutional provisions. This is in addition to discussing appeals after elections are held, reported Al-Watan. Therefore, he said that the grilling motions are not discussed, adding that they can only explain the clause that addresses the Constitution's grilling.
Al-Wasmy made comments that further supported Al-Feely's statements, indicating that the Court's regulations do not include clauses that entitle it to discuss the constitutionality of a grilling or examine its clauses.
