Immediate Sponsorship Transfer if Employers Delay Dues' Payment |
|
ABU DHABI - The Ministry of Labour (MoL)Ministry of Labour (MoL)
will immediately approve transfer of sponsorship of retrenched employees whose employers haggle over payment of end-of-service benefits and delayed salaries.
Speaking at the ministry's open day on Monday, a senior MoLMoL
official said the ministry will suspend the establishment's licence if a sacked employee lodges a complaint with the ministry, and if a court has issued a verdict in favour of the employee protecting his/her right to transfer of visa.
"If the service of an employee, who signed a limited contract, is terminated, his/her employer must pay him/her the end-of-service gratuity, as ruled ?by the court, and which often ?amounts to three months' salary ?plus payment of delayed wages, if any, as well as all dues stipulated in the employment contract," said Humaid Rashid bin Deemas Al Suwaidi, acting director-general of the ministry.
"The ministry rejects any attempts to mount pressure on workers to ?surrender their rights which are acknowledged and stipulated by the labour law and the ministerial decrees," Al Suwaidi reiterated.
"Employers should be committed ?to employees' rights and should not link them to circumstances or crises, ?so workers cannot be forced to surrender their rights under any circumstances the economy or the labour market may experience," he pointed out.
The ministry wants the relation ?between both the employer and ?employee to be an amicable one ?under which the mutual respect prevails, and without prejudice to workers' rights, he said.
