Law to regulate buildings in RAK

Ras Al Khaimah, 10th July 2009 (WAM) -- The building sector in the emirate of Ras Al Khaimah will be better regulated under a new law issued by H.H.

Sheikh Saud bin Saqr Al Qasimi, Crown Prince and Deputy Ruler of Ras al-Khaimah.

Provisions of law no 1 of 2009 for regulating buildings in the emirate shall be applicable to all buildings with exception of those come under a special decree or resolution.

''No one shall construct a building or make any additions, expansions or partly or wholly demolish it or make any modifications whether on the facet or internal divisions without obtaining a permission from the competent section of the emirate's municipality, the law stipulates.

The law covers a wide range of topics dealing with buildings starting from designs, construction license, architectural standards and specifications, additions, expansions, maintenance and safety and security systems up to penalties for breaching provisions of the law.

According to the law, the construction permit shall be valid for one year from the date of issuance and deem null and void if no construction activities are made on the site within the said period or if works stop for more than six months without justifiable reasons. The permit can be renewed in 30 days after its expires.

The architect shall be responsible for the safety of the building ten years after its delivery.

The chairman of the municipality may instruct the authorities concerned to remove unlicensed pounds, caravans and makeshift houses if their owners fail to do so after the expiry of the grace period given to them.

On recommendations of a technical committee, the chairman of the municipality may order demolition of any worn-out buildings or facilities which may pose danger to inhabitants and passers-by or harm the environment and the public health.

The chairman of the municipality shall issue the executive regulations of the law which abrogates law no 6 of 1996 and what contradicts it.

The law shall go into force one month after its issuance and shall be published in the gazette.
